Terms of Service

1. Who we are, and what these terms cover

"TurnPOS," "we," and "us" mean NK Hardware, LLC, a Georgia limited liability company. These terms cover (a) your use of the turnpos.com website, and (b) the TurnPOS point-of-sale service for salons ("the Service"). A salon's subscription is confirmed in a written order form or service agreement signed at signup; if that document conflicts with these terms, the signed document wins. Payment processing (merchant accounts) is provided under a separate merchant agreement with the payment processor and its sponsor bank.

2. Using the website

The site is provided as-is for information. The savings calculator provides estimates for illustration only — actual pricing is quoted in writing from your real processing statement. Don't misuse the site (no scraping at scale, no attempting to breach security, no unlawful use).

3. Accounts and acceptable use of the Service

• You're responsible for your login credentials and your staff's PINs, and for the accuracy of the information your salon enters.
• Use the Service only for lawful business purposes, and only for a bona fide business you operate.
• You are responsible for complying with laws that apply to your salon — including employment, tax, tip-handling, and consumer-notice requirements (for example, posting dual pricing signage where used). TurnPOS provides tools and calculations, not legal, tax, or accounting advice.

4. Fees

Software subscription fees, and any hardware prices, are stated in your written order. Your card processing rate is quoted in writing before you sign. We don't add hidden or "junk" fees. Taxes, where applicable, are your responsibility.

5. Hardware

• Purchased equipment is yours — no lease-backs and no return penalties from us.
• Rented equipment (where offered) remains ours and must be returned in working order, normal wear excepted, within 14 days of the rental ending; otherwise the replacement price in your order applies.
• Manufacturer warranties apply to hardware; we help you exercise them.

6. Your data

• Your business data belongs to you. Services, tickets, customers, staff, reports — yours. We process it only to provide the Service, as described in our Privacy Policy.
• If you leave, your data leaves with you. On request within 60 days of cancellation, we provide an export of your business data in a standard format, then delete what we're not legally required to keep.
• We maintain encrypted backups at independent providers and industry-standard security controls. Card numbers never touch the Service (see Privacy Policy).

7. Availability and support

We build for reliability — redundant infrastructure, continuous backups, monitored systems — but no software service can promise 100% uptime, and the Service depends on your internet connection. Support is available 9am–5pm Eastern, seven days a week, by phone, text, or voicemail at 678-425-8149.

8. Term and cancellation

• Subscriptions run month-to-month unless your order says otherwise. You may cancel with 30 days' notice — no cancellation penalties from us.
• We may suspend or end service for non-payment, unlawful use, or abuse of the Service or our staff, with notice where practicable.
• Sections that by their nature survive (your data rights, payment of accrued fees, liability limits, governing law) survive cancellation.

9. Disclaimers and limits of liability

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. Nothing in these terms limits liability that cannot be limited by law.

10. General

• Governing law and venue: Georgia law; courts located in Gwinnett County, Georgia.
• Changes: we may update these terms; material changes will be posted here with a new effective date and emailed to active customers 30 days in advance. Continued use after the effective date is acceptance.
• Assignment: you may not assign these terms without our consent; we may assign to a successor of the business.
• Entire agreement: these terms plus your signed order and the Privacy Policy are the whole agreement for the Service between you and us.
